These terms and conditions regulate the business relationship between you, the customer and African Street Craft.
By accessing this website we assume you accept these terms and conditions in full. Your attention is drawn to these Terms and Conditions because they are important and should be carefully noted. Do not continue to use ‘s website if you do not accept all of the terms and conditions stated on this page.
1 Introduction and definitions
1.1 This website can be accessed at www.africanstreetcraft.com (the “Website”) and is owned and operated by African Street Craft (“African Street Craft”, “we”, “us” and “our”).
1.2 These Website Terms and Conditions (“Terms and Conditions”) govern the ordering, sale and delivery of Goods, and the use of the Website.
1.3 These Terms and Conditions are binding and enforceable against every person that accesses or uses this Website (“you”, “your”, “consumer“, “customer“, “client” or “user”)
1.4 The website enables you to shop online for a variety of arts and crafts including paintings, bead and wire sculptures, tin crafts. The previous mentioned arts and crafts for sale on our website could be referred to as “Goods” or “Products”
1.5 “Content” means information in any form published on Our Web Site by us or any third party with our consent.
1.6 If there is any provision in these Terms and Conditions that you do not understand, it is your responsibility to ask African Street Craft to explain it to you before you accept the Terms and Conditions or continue using the Website.
1.7 By accessing and using the Website, the User agrees to be bound by the Terms and Conditions set out in this legal notice. The User may not access, display, use, download, and/or otherwise copy or distribute Content obtained on the website for marketing and other purposes without the consent of the Provider.
2 Goods and Services
2.1 African Street Craft is a South African based business that provides the service of an online art gallery.
2.2 Our service is not only limited to South African based consumers. We sell to international customers anywhere world wide
2.3 Our online shop’s product range includes a variety of arts and crafts including paintings, bead and wire sculptures, tin crafts and wooden or stone sculptures.
2.4 Additional materials of arts and crafts may be added to the above mentioned range of goods at any future stage without notice.
2.5 Framing may be offered as an optional add-on to paintings but this service will only apply to consumers based in South Africa.
2.6 African Street Craft will not be responsible for the framing of artwork for any client outside of South Africa who wishes to get their art work framed.
2.6 Product pictures displayed on our site may vary slightly from the real product that you will receive after making your purchase. This may be owing to colouration editing or lighting of our product photographs. We will not be liable for any slight variations of such once your purchase has been made. If you are unhappy with your purchase upon arrival, please see section 7 in these terms for our returns and refunds policy.
2.7 Our prices depend on materials used by the artist, labour time, artist demand and shipping location for deliver however we are not obligated to disclose the exact calculations of our selling price.
2.8 Artist commissions and recreations of previous art work may also vary from previous art works done, which may be used as a reference. Special requests of this nature are nonrefundable as we cannot take responsibility for the artists near impossible skill to 100% replicate a previous piece.
3.1 Purchase of products – When you order a product from our website you are offering to buy it at the price stated, subject to these terms. We will take all reasonable care to ensure that all details, descriptions and prices of products appearing on the website are correct at the time when the relevant information was entered onto the system.
3.2 We reserve the right to refuse an order. Non-acceptance of an order may, for example, result from one of the following:
- The product ordered being unavailable from stock
- Our inability to obtain authorisation of payment
- The identification of an error within the product information, including price or promotion
3.3 Your receipt of an electronic or other form of order confirmation does not signify our acceptance of your order, nor does it constitute confirmation of our offer to sell. We reserve the right at any time after receipt of your order to accept, decline, or limit your order for any reason, whether or not your credit card has been charged. If your credit card has been charged and your order is cancelled, you will receive a refund.
3.4 Once an order has been placed, it cannot be cancelled unless the shipment is unavoidably delayed. In this case, we will do our best to cancel the order if requested.
4.1 African Street Craft accepts International Orders but the excess cost of courier will be charged to the buyer.
4.2 Prices displayed on the Site are shown in South African Rands but can be change to Euros, US Dollars and Pound Sterling via our multi currency drop down on the header of each page.
4.3 All pricing for our products is subject to change. For all of our prices and products, we reserve the right to make adjustments due to changing market conditions, currency fluctuations, product discontinuation, errors in advertisements, and other extenuating circumstances.
4.4 Delivery fees will be charged in addition to the price of the products. South African consumers based in Gauteng will receive free delivery for products purchased unless special courier means are needed to transport heavy goods.
4.5 For heavy items, we may ask you to pay an extra fee, to cover the specific shipping cost.
4.6 Products will not be dispatched for courier until full payment, including delivery charges are paid in full. This would include any additional fees mentioned in 4.3, pertaining to heavy items.
4.7 You may be required to pay an additional handling fee to the courier company who is delivering your product. This cost will not be included in the price shown on the checkout for your product on our website and it is your responsibility to pay this fee directly to the courier company as this does not involve us in any way.
4.8 You may also be liable for any customs and import duty, quotas, permits, product restrictions and other local requirements. These charges must be paid by the recipient of the parcel. Customs policies vary widely from state to state and country to country. Therefore we suggest that you check the requirements in your country before placing an order. We will not be liable for any custom or import duties.
5.1 Payment options – African Street Craft accepts payment through Paygate, Zapper and Paypal.
5.2 Online card payments will be accepted even if you do not have a Paypal, Zapper or Paygate account.
5.3 Payment may be made via Visa, MasterCard, Diners or American Express Cards or by bank transfer into the African Street Craft bank account, details of which will be provided upon request.
5.4 For users outside of South Africa, we suggest that you do not make use of the option to make payments directly into the African Street Craft account. This process will be substantially longer than making use of our online payment options and we will not dispatch your product until we receive full payment.
6 Delivery/shipping policy
6.1 Delivery of goods purchased will be made by means of courier. Paintings will be rolled up and sent in a mailing tube for orders outside of South Africa.
6.2 South African customers do have the option of collecting their own products but this needs to be arranged by contacting email@example.com. Further details will be provided upon request.
6.3 Subject to availability and receipt of payment, requests will be processed within 3 working days and delivery confirmed by way of an order receipt with a booking number sent via email. This email receipt should be generated automatically through our website, directly after payment. If you realise that you have submitted an incorrect email address or do not receive an order receipt via email with 24 hours after your successful purchase , please contact firstname.lastname@example.org.
6.4 African Street Craft only ships orders Monday to Friday, during office hours, and does not operate on public holidays. We aim to process your order within 72 hours of it being placed and paid for. Please allow for 7 – 14 working days for delivery.
6.5 Delivery may take longer than 14 working days, depending on your location.
6.6 If delivery will take longer than 30 days after payment date, we will make with contact you as soon as we are able, to inform you of the delay and expected arrival.
6.7 Once an order has been registered and payment accepted, and order shipped, it is in the courier service. We are not liable for any errors made by these services.
6.8 Once you have received your parcel, please open it with care. African Street Craft is not liable for any items damaged during the opening of your parcel.
6.9 We cannot be held responsible for an incorrect address being entered while ordering on our website. If you complete your Order and then notice that the address details are incorrect, please contact us immediately on email@example.com
6.10 However, in the result of a package not being delivered to you because of loss in transit or if the product arrives damaged beyond use, we will ensure that you receive a full refund of your purchase.
6.11 For information relating to our delivery/courier cost implications, please refer to section 4 of our terms – prices.
7 Return and refunds policy
7.1 We strive for all of our customers to be happy with any purchases made from African Street Craft. However, if you receive any products that you are unhappy with, you may contact us within 2 weeks of receiving it and we will offer you a store credit of the item. The purchase price is the amount you paid for the product and does not include any delivery costs.
7.2 All products are returnable, excluding:
- All Products bought on sale
7.3 Products returned must be undamaged. We shall have no obligation to accept any return that we receive after the expiration of the applicable return period (2 weeks after receipt of your product) and you will be liable for any shipping fees incurred by the return unless otherwise agreed upon with African Street Craft. Please ensure when returning the parcel that the Products are properly protected.
7.4 The provision of goods and services by African Street Craft is subject to availability. In cases of unavailability, African Street Craft will refund the client in full within 30 days.
7.5 Cancellation of orders by a client will attract a 5 % administration fee, provided the item has not been dispatched for shipping. If the goods have been dispatched the order may not be applicable for cancellation.
7.6 If your product is damaged upon arrival, the courier company must be informed immediately upon delivery of the product and you must inform African Street Craft of the damage within 2 weeks of receiving the product. Any notice given later than 2 weeks will not be accepted by us.
7.7 Damaged goods will be replaced provided the terms in 7.6 are met and subject to photographic evidence of the damaged product sent through which will be the consumer’s responsibility.
7.8 Damaged goods will be replaced with similar products or replications of the artwork, suitable to the consumers requirements provided the cost of the new good is similar to that of the damaged good.
7.9 Despite goods that are damaged upon arrival, African Street Craft will not be held liable for goods damaged by a consumer and we offer no guarantees on the life span of our products.
African Street Craft shall take all reasonable steps to protect the personal information of users, if provided. For the purpose of this clause, “personal information” shall be defined as detailed in the Promotion of Access to Information Act 2 of 2000 (PAIA). The PAIA may be downloaded from:
9 Card acquiring and security
9.1 Online card transactions and relating details will not go through African Street Craft. This will be handled by PayGate and PayPal. The only instance we may ask for your account details is in the occurrence of refunds or direct payments between you and African Street Craft when the online payment gateway option is not utilised.
9.2 Card transactions will be acquired for African Street Craft via PayGate (Pty) Ltd who are the approved payment gateway for all South African Acquiring Banks. PayGate uses the strictest form of encryption, namely Secure Socket Layer 3 (SSL3) and no Card details are stored on the website. Users may go to www.paygate.co.za to view their security certificate and security policy.
9.3 Card transactions may also be handled by PayPal who provide their own terms and policies which can be viewed on www.paypal.com
10 Customer details separate from card details
Customer details will be stored by African Street Craft separately from card details which are entered by the client on PayGate’s or PayPal’s secure site. For more detail on PayGate refer to www.paygate.co.za. For Paypal refer to www.paypal.com
11 Merchant Outlet country and transaction currency
The merchant outlet country at the time of presenting payment options to the cardholder is South Africa. Transaction currency is South African Rand (ZAR).
African Street Craft takes responsibility for all aspects relating to the transaction including sale of goods and services sold on this website, customer service and support and dispute resolution.
13 Country of domicile
This website is governed by the laws of South Africa and African Street Craft chooses as its domicilium citandi et executandi for all purposes under this agreement, whether in respect of court process, notice, or other documents or communication of whatsoever nature.
African Street Craft may, in its sole discretion, change this agreement or any part thereof at any time without notice.
15 Limited licence to general users
15.1 We grant to the user, subject to the further terms of these Terms and Conditions, a non-exclusive, non-transferable, limited and revocable right to access, display, use, download and otherwise copy the current and future Content for personal, non-commercial and information purposes only.
15.2 This Website and the Content may not be reproduced, duplicated, copied, resold, visited or otherwise exploited for any commercial purpose without the express prior written consent of African Street Craft. The license does not allow the user to collect product or service listings, descriptions or other information displayed here, and does not allow any derivative use of this Website or the Content for the benefit of another merchant. The User may not frame nor use framing technologies to enclose the Provider Website or the Content nor any part thereof without the express written consent of African Street Craft.
15.3 You agree that you will not in any way use any device, software or other instrument to interfere or attempt to interfere with the proper working of the Website. In addition, you agree that you will not in any way use any robot, spider, other automatic device, or manual process to monitor, copy, distribute or modify the Website or the information contained herein, without the prior written consent from an authorised African Street Craft representative.
15.4 You may not use the Website to distribute material which is defamatory, offensive, contains or amounts to hate speech or is otherwise unlawful.
15.5 You may not in any way display, publish, copy, print, post or otherwise use the Website and/or the information contained therein without the express prior written consent of an authorised African Street Craft representative.
16 Limitation of Liability
The website and all Content on the website, including any current or future offer of products or services, are provided on an “as is” basis, and may include inaccuracies or typographical errors. African Street Craft makes no warranty or representation as to the availability, accuracy or completeness of the content. Neither We shall not be held responsible for any direct or indirect special, consequential or other damage of any kind whatsoever suffered or incurred, related to the use of, or the inability to access or use the Content or the Website or any functionality thereof, or of any linked website, even if African Street Craft is expressly advised thereof.
17 Persons under the age of 18
17.1 By using the Website you warrant that you are 18 (eighteen) years of age or older and of full legal capacity. If you are under the age of 18 (eighteen) or if you are not legally permitted to enter into a binding agreement, then you may use the Website only with the involvement and supervision of your parent or legal guardian. If your parent or legal guardian supervises you and gives his/her consent, then such person agrees to be bound to these Terms and Conditions and to be liable and responsible for you and all your obligations under these Terms and Conditions.
